About MPSC
Article 315 of the Indian constitution stated that, “Every state should have a Public Service Commission”.As given under a constitutional provision the Public Service Commission is not under any Government Department, it is an autonomous body .As it has been given a high autonomous power , any expense of the Public Service Commission is not supposed to be taken to vote by the Legislative Assembly but CHARGED to the consolidate fund of the State. Even if the budget of the Public Service Commission is discussed in the Legislative Assembly it is not required to be put to vote. As it has been set up to run almost like a parallel Government, so as not to confuse it with any other Government Department and to emphasize its difference and so that the Public Service Commission may not confuse itself, the Supreme Court and High Court in different rulings has made certain observations as the following. a) The Public Service Commission has a distinct status under the Constitution, apart from the Government of the Union or of the State and cannot be identified with such Governments. (I.L.R (1954) Madh. Bh256:A.I.R.1955 Madh. Bh. 56) b) The Public Service Commission has a distinct and distinguished status under our Constitution. It cannot and should not identify itself with the Government authorities. {(1968) 1 M.L.J 348,351: Lab. I.C 1377.}Since it has been given such a high position, the Public Service Commission has the authority to make up its own rules and regulations as per its requirements. As the Public Service Commission is considered to be an Expert Body such Rules and Regulations made up for its own use cannot be disregarded by a Court of Law. {1996(5) SLR 375 State of Punjab Vs. Kamal Dev (Pb & Hry)} Art-320 of the Indian Constitution has stated that the Public Service Commission shall conduct Examinations and interviews for recruitment to various Government posts. The State shall also seek the opinion of the Public Service Commission regarding promotion, punishment, change of service of personnel’s under the State Government. This includes the Government employees from the highest to the lowest ranks.
